1. Agreement to Terms

By accessing or purchasing from BH Designs ("we", "our", "the company"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our website or services.

2. All Sales Are Final

All plan purchases are final. Because house plans are digital products that are delivered immediately upon purchase, we do not offer refunds or exchanges under any circumstances. We strongly encourage you to:

  • Review all plan details, floor plans, and specifications carefully before purchasing.
  • Download and view any available free sample plan.
  • Contact us with any questions before completing your order.

3. Copyright & Licence

All house plans sold through BH Designs are protected under the South African Copyright Act 98 of 1978 and applicable international copyright law. The original architect or designer retains full title and ownership of all plans at all times.

When you purchase a plan, you are granted a limited, non-exclusive, non-transferable licence to use the plans as follows:

  • PDF – 1 Set: Licence to construct one (1) structure only.
  • PDF – 5 Sets: Licence to construct up to five (5) structures.
  • CAD + Reproducible: Licence to print unlimited copies and construct unlimited structures.

You may not:

  • Reproduce, copy, or distribute the plans by any means beyond your licence.
  • Resell, transfer, or pass on the plans to any other person or organisation.
  • Use the plans to construct more homes than your licence permits without purchasing an extended licence.

Sharing plans with your appointed builder, architect, or engineer solely for the purpose of constructing your home is permitted.

4. Building Codes & Compliance

Our plans are designed to comply with industry-standard building codes at the time they were drawn. However:

  • Every South African province, municipality, and local authority has its own building regulations, zoning requirements, and submission standards in terms of the National Building Regulations and Building Standards Act (Act 103 of 1977) and SANS 10400.
  • BH Designs does not guarantee that any plan will meet the requirements of your specific local authority without modification.
  • Pre-drawn plans do not carry a stamp from a registered South African Professional Architect (PrArch) or Professional Engineer (PrEng). You will need to engage a registered professional to certify and submit plans to your local municipality.
  • Plans for properties in areas subject to seismic activity, flooding, high winds, or expansive soils may require additional structural engineering review.

5. Plan Modifications

BH Designs can arrange modifications to any plan. Modification quotes are provided free of charge with no obligation. To request a quote, use the "Request a Modification Quote" link on any plan page or contact us directly. Modification timelines and pricing will be confirmed in writing before any work commences.

6. Delivery

Plans are delivered digitally by email. Delivery typically occurs within 1–2 business days of confirmed payment. BH Designs is not responsible for delays caused by incorrect email addresses provided at checkout or by your email provider's spam filters. See our Shipping & Delivery page for full details.

7. Pricing

All prices are displayed in South African Rand (ZAR) and are inclusive of VAT where applicable. Prices are set by the original designers and architects and may change without notice. The price charged at the time of purchase is final.

8. Electronic Communications

By using our website and making a purchase, you consent to receive communications from BH Designs electronically, including order confirmations and plan delivery by email. You agree that electronic communications satisfy any legal requirements for written communication.

9. Limitation of Liability

BH Designs shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of our plans, including but not limited to construction defects, non-compliance with local building codes, or delays in construction. The purchaser assumes full responsibility for verifying plan suitability for their intended use and location.

10. Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts.
